This is the agreement between you and Hello Radio LLC, the Texas company that operates Granted Day, at 1701 Bassett Ave, Suite 151, El Paso, TX 79901. Using the app or the website means you accept it. Two things are worth reading before the rest: your subscription renews automatically until you cancel, and disputes are settled by individual arbitration rather than in court, which you can opt out of within thirty days.

What Granted Day is

A subscription that writes you one short piece of encouragement each morning, personal to what you told it, delivered by notification or email, with a second short piece at night.

What Granted Day is not

It is not medical, psychological, psychiatric, legal, or financial advice, and it is not therapy. It does not diagnose, treat, or prevent anything, and it is not a substitute for care from a qualified professional. Talk to one before making decisions about your health, your money, or your life.

It is not a crisis service and nobody is watching. The app cannot detect an emergency and no person reads what you write. If you are in danger or thinking about harming yourself, call or text 988 in the United States, or call 911.

Nothing here is a promise that anything will happen. Granted Day makes no guarantee of any outcome, financial, professional, physical, or personal, and no result is promised, implied, or typical. Reading a sentence does not cause an event.

Who can use it

You must be 18 or older to subscribe. Granted Day is offered in the United States only. Your account starts on your device, with no password, so keeping your device locked is what keeps it yours. When you subscribe or restore on iPhone or iPad, it is linked to Sign in with Apple, so it can follow you to a new phone.

The trial, the price, and automatic renewal

On the web and on Android, every account starts with a 7 day free trial. No card is needed to begin it.
On iPhone and iPad, the free week is Apple’s: either plan starts with one week free, taken through the App Store. When the week ends, the plan you chose is charged to your Apple ID and renews automatically. Cancel in your device’s Settings at least 24 hours before the week ends and nothing is charged. The free week is offered once per Apple ID.
After the trial, Granted Day is $9.99 per month or $69.99 per year.
Your subscription renews automatically at the end of every period, at the then-current price, and keeps renewing until you cancel it. You are charged at the start of each period.
On the web and on Android, nothing is charged when the trial ends unless you have chosen a plan and entered payment. That trial does not turn into a paid subscription by itself.
If the price changes, we will tell you before it applies to you, and you can cancel first.

Cancelling

On iPhone and iPad, cancel in Settings under your Apple ID, then Subscriptions. On Android and the web, cancel from the app or from the billing portal. You keep access until the end of the period you already paid for, and you are not charged again. Deleting the app does not cancel a subscription.

Refunds

Payments are not automatically refunded for a period already begun. If something went wrong, write to info@granted.day and we will look at it honestly and often refund it. If you bought through an app store, that store’s refund policy applies instead. None of this limits any right you have under the law where you live.

What you write, and what we write

What you type stays yours. You give us permission to store and process it for the single purpose of writing and delivering your mornings, which is set out in the privacy policy. The mornings written for you are yours to keep, print, and share for your own use. The app itself, its name, and its design are ours.

Your mornings are written by an AI model. It is capable of being wrong, and no person reviews what it wrote before it reaches you. Treat it as what it is: something written for you overnight by a machine, not a statement of fact about the world.

How you may use it

Personally, and for yourself. Do not resell it, scrape it, reverse engineer it, attack it, use it to harass anyone, or share one account across many people.

Availability

We try to deliver every morning and we do not promise to. A late or missing morning is not a breach of this agreement. We may change, suspend, or discontinue any part of Granted Day, and if we shut the service down we will tell you and stop billing you.

Disclaimer of warranties

GRANTED DAY IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT IT WILL BE UNINTERRUPTED, ERROR FREE, OR THAT ANY CONTENT IT PRODUCES WILL BE ACCURATE OR SUITABLE FOR YOU. SOME STATES DO NOT ALLOW THESE EXCLUSIONS, IN WHICH CASE THEY DO NOT APPLY TO YOU.

Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, HELLO RADIO LLC AND ANYONE WORKING WITH IT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE WERE TOLD SUCH DAMAGES WERE POSSIBLE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO GRANTED DAY IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR ONE HUNDRED U.S. DOLLARS. SOME STATES DO NOT ALLOW THESE LIMITS, IN WHICH CASE THEY APPLY ONLY AS FAR AS THE LAW ALLOWS.

Indemnity

If your use of Granted Day, or your breach of these terms, causes a claim against us from someone else, you agree to cover the reasonable cost of defending it.

Arbitration, and giving up class actions

You and Hello Radio LLC agree that any dispute between us will be settled by binding individual arbitration rather than in court, administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration may be held by phone or video, or in El Paso County, Texas.

You and we both give up the right to a jury and the right to take part in a class action, and an arbitrator may only award relief to you individually. Either of us may still bring an individual claim in small claims court instead.

You can opt out. Email info@granted.day with the subject line “arbitration opt-out” within thirty days of first accepting these terms, and this section will not apply to you. Nothing else changes if you do. If the class action waiver is found unenforceable, this whole section does not apply.

Governing law

Texas law governs this agreement, without regard to conflict of laws rules. Anything not going to arbitration goes to the state or federal courts in El Paso County, Texas.

Ending it

You can stop at any time by cancelling and deleting your account. We may suspend or close an account that breaks these terms or is being used to harm someone, and we will refund any unused paid time if we do.

If you got the app from a store

Apple and Google are not parties to this agreement, have no obligation to support Granted Day, and are not responsible for it. They are third-party beneficiaries of these terms and may enforce them against you.

Changes to these terms

We may update this page. If a change matters, we will tell you before it takes effect, and continuing to use Granted Day after that is how you accept it. If you do not, cancel and delete your account.

Everything else

If any part of this is unenforceable, the rest still stands. This page, with the privacy policy, is the whole agreement between us. We may transfer it if the business changes hands. Not enforcing something once does not mean giving it up. Neither of us is responsible for failures caused by things genuinely outside our control.
